Defining Public Sector Status

Based on Title II, Chapter 26 of US Code on The Congress and Disclosure of Lobbying Activities

If yes to any of these questions, then YOU ARE a public sector member:

  1. Are you a direct employee of a federal, state or local government?
  2. Are you a direct employee of an association or organization of state or locally elected or appointed individuals?
  3. Are you a direct employee of a state or national political party?
  4. Are you a direct employee of a national, regional, or local unit of foreign government or a group of foreign governments acting as an international organization?

If yes to any of these questions, then YOU ARE NOT a public sector member:

  1. Are you an employee of the following:
    1. A college or university;
    2. A government sponsored enterprise;
    3. A public utility providing gas, electricity, water or communications;
    4. A guaranty agency; or
    5. An agency of any state functioning as a student loan secondary market
  2. Are you an independent contractor, consultant or volunteer?
